SUCCESSFUL PRACTICE
In the State of New Jersey a parent cannot unilaterally take a child out of the State of New Jersey and reside without the consent of the other parent. These matters are commonly referred to as"removal matters". Whether they are during the Divorce or after the Divorce, it opens up issues to the Court that have to be adjudicated in the proper form. It is not enough to come to the Court and say "I have a new job and I must leave the State of New Jersey with my children". The case law that has developed over the years makes it more complicated and burdensome to the parent seeking to remove a child from the State of New Jersey. Its is not an impossible task and we have had great success at this firm in allowing our clients to leave the State of New Jersey.
Likewise, if you are objecting to the removal of a child from the State, it is not as simple as to go before the Court and say "I object because I do not want my child leaving the State of New Jersey". There are factors that must be articulated to the Court in order to convince the Court to have the child stay in the State of New Jersey.
We are extremely familiar with the factors to remove the child and to keep the child or children in the State of New Jersey. If the Court requires a hearing, we are familiar with the factors needed to bring the Court's attention one way or the other. There is one thing clear about a removal matter and that is that this issue should not be brought before the Court without a law firm that is truly familiar with the case law pertaining to the issue of removal.
